Eligibility and Account Responsibility
You must be legally able to enter into these Terms and must use Thawing Fox only for business or professional purposes, or other lawful purposes, using mailboxes that you own or are authorized to operate. You are responsible for your account, your devices, your browser sessions, and all activity that occurs through them.
Manual Installation and Third-Party Platforms
Thawing Fox is a browser extension that is manually installed. It is not distributed through the Chrome Web Store. You are responsible for installing, using, and maintaining the extension in a manner that complies with your browser, operating system, and mailbox-provider requirements.
Thawing Fox is not affiliated with, endorsed by, or sponsored by Google, Gmail, Microsoft, or Outlook. Your use of Gmail, Outlook, Google, Microsoft, and any related accounts remains subject to those third parties' own terms and policies.
License
Subject to these Terms, Flowy grants you a limited, non-exclusive, non-transferable, revocable license to use the Thawing Fox site and extension for your internal use. We reserve all rights not expressly granted.
How the Service Operates
Thawing Fox automates actions inside supported Gmail and Outlook web sessions. Depending on the features you enable, the service may prepare warmup emails, append a tracking reference such as Ref: TF-XXXX, search mailbox interfaces for that reference, detect inbox or spam placement, move messages from spam or junk to inbox, mark messages as read, and send replies on your behalf through your active webmail session.
You authorize Thawing Fox to perform those actions only to the extent you enable and use the relevant features. You remain solely responsible for the content sent from your mailboxes and for the consequences of those actions.
Acceptable Use
You agree not to use Thawing Fox to:
- Send unlawful, deceptive, abusive, or unsolicited messages in violation of applicable law or third-party rules.
- Access, monitor, or manipulate mailboxes or accounts that you are not authorized to use.
- Interfere with, disrupt, reverse engineer, or misuse the service, our systems, or third-party platforms.
- Use the service in a way that violates anti-spam, privacy, consumer protection, export, or data-protection laws.
- Attempt to bypass plan limits, security controls, suspensions, or technical restrictions.
User Compliance Obligations
You are responsible for making sure your use of Thawing Fox complies with all applicable laws, regulations, mailbox-provider terms, workplace policies, and contractual obligations, including rules governing commercial email, consent, disclosure, and recordkeeping. Thawing Fox provides tooling, not legal advice.
Billing and Paid Plans
Some features require a paid subscription. Pricing, plan limits, and feature availability may change prospectively. Billing and subscription management may be handled by third-party providers such as Stripe. Your payments are subject to the applicable checkout terms and the terms of the payment processor you use.
Unless required by law, fees are non-refundable once charged. We may suspend or downgrade paid access if payment fails or your subscription ends.
Suspension and Termination
We may suspend, restrict, or terminate access to Thawing Fox at any time if we reasonably believe you breached these Terms, created risk for us or others, failed to pay amounts due, or used the service in a way that could expose Flowy or third parties to liability. You may stop using the service at any time by uninstalling the extension and discontinuing access.
Intellectual Property
Thawing Fox, including its software, design, branding, documentation, and related materials, is owned by Flowy or its licensors and is protected by intellectual-property laws. Feedback you provide may be used by us without restriction or compensation.
Disclaimers
Thawing Fox is provided on an as is and as available basis. To the maximum extent permitted by law, Flowy disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the service will be uninterrupted, error-free, secure, or compatible with any third-party platform.
Email deliverability, inbox placement, spam filtering, browser compatibility, and mailbox-provider behavior are influenced by third parties and factors outside our control. We do not guarantee any specific result.
Limitation of Liability
To the maximum extent permitted by law, Flowy, LLC and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunities, or mailbox access arising out of or related to Thawing Fox. Our aggregate liability for any claim arising out of or relating to the service will not exceed the greater of the amount you paid us for the service in the three months before the event giving rise to the claim or one hundred U.S. dollars (US $100).
Indemnity
You will defend, indemnify, and hold harmless Flowy, LLC and its affiliates, officers, employees, and agents from and against claims, losses, liabilities, damages, judgments, and expenses arising from your use of Thawing Fox, your content, your mailbox activity, or your violation of these Terms or applicable law.
Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service must be brought exclusively in the state or federal courts located in Delaware, and you consent to that jurisdiction and venue.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may update the effective date above and provide notice through the site, the extension, or other reasonable means. Your continued use of Thawing Fox after updated Terms become effective constitutes acceptance of the updated Terms.
